AllCare Plus Pharmacy data breach settlement: How to file a claim

AllCare Plus Pharmacy, a healthcare provider with locations in Massachusetts and New Hampshire, experienced a significant data breach in June 2022. The breach exposed sensitive personal and financial information of nearly 6,000 individuals. Following a class action lawsuit, AllCare Plus Pharmacy has agreed to a settlement, offering compensation and identity protection services to those affected.

What happened?

On April 14, 2022, AllCare Plus Pharmacy suffered an external system breach due to hacking activities. The breach was discovered on June 21, 2022. Sensitive consumer information, including personal and financial details, was compromised as a result. Although AllCare has not admitted any wrongdoing, the company agreed to settle the claims related to the incident to resolve the litigation efficiently.

  • Full names and addresses
  • Dates of birth
  • Social Security numbers
  • Driver’s license numbers
  • Financial account information (including debit or credit card data with security codes or PINs)
  • Health information, health insurance details
  • Prescription and treatment information

Who is affected?

The AllCare Plus Pharmacy data breach impacted approximately 5,971 individuals. Among those affected, 15 residents were identified in the state of Maine. Individuals who had their information compromised in the AllCare Plus Pharmacy data breach of June 2022 are eligible to receive settlement benefits. Both current and former customers are included within the class definition, provided their data was involved in the incident.

Settlement compensation details

Under the terms of the settlement, eligible class members can receive compensation for their losses and time spent dealing with the breach. The options include:

  • Up to $750 reimbursement for unreimbursed fraud, identity theft losses, professional fees, credit monitoring costs, and related expenses.
  • Up to $5,000 reimbursement for extraordinary losses due to fraud or identity theft, with appropriate supporting documentation such as police reports, affidavits, or detailed financial records.
  • Lost time reimbursement at a rate of $20 per hour, for up to five hours, totaling a maximum of $100.
  • Alternative cash payment of $50 for class members who prefer not to submit documentation for other claims or services.
  • Two years of free credit monitoring and identity theft protection through IDX, including $1 million in identity theft insurance coverage.

All claim types require submission of appropriate forms and documentation where applicable to substantiate claims.

How to claim your benefits

Class members must submit a valid claim form no later than July 3, 2025 to be eligible for settlement benefits. Claimants may choose between reimbursement options or the alternative cash payment based on their circumstances.

Required documentation for reimbursement claims may include:

  • Bank statements showing unauthorized transactions
  • Credit reports indicating fraudulent activity
  • Police reports filed due to identity theft incidents
  • Invoices or receipts for professional services like identity recovery assistance

Important deadlines and legal information

  • Claim Submission Deadline: July 3, 2025
  • Exclusion/Objection Deadline: July 3, 2025
  • Final Approval Hearing: August 27, 2025

The final hearing will be held in the Suffolk County Superior Court of the Commonwealth of Massachusetts. The case is officially titled Celeste Brown, et al. v. AllCare Plus Pharmacy LLC, Case No. 2484CV02366.
